{"id":847,"date":"2018-07-06T17:00:52","date_gmt":"2018-07-06T15:00:52","guid":{"rendered":"http:\/\/www.aviationadvocacy.aero\/blog\/?p=847"},"modified":"2019-07-23T11:42:53","modified_gmt":"2019-07-23T09:42:53","slug":"that-was-the-week-that-was-2-6-july","status":"publish","type":"post","link":"https:\/\/www.aviationadvocacy.aero\/blog\/?p=847","title":{"rendered":"That Was The Week That Was: 2 \u2013 6 July"},"content":{"rendered":"The theme this week was control.\u00a0 Who is in control matters in air transport.\u00a0 The most famous question of control is the test of nationality of an airline.\u00a0 Yes, you might think that is an antediluvian topic to even consider, but hey!\u00a0 Welcome to the regulation of aviation, where the calendar is permanently stuck on 1944. \u00a0That is the most famous control, but there are others.<!--more-->\r\n\r\n<strong>Monday<\/strong> saw the <a href=\"http:\/\/www.europarl.europa.eu\/RegData\/questions\/reponses_qe\/2018\/002422\/P8_RE(2018)002422_EN.pdf\">response<\/a> of the Commissioner for Transport, Violetta Bulc to yet another pointed question about the effective control of Air Italy, formerly Meridiana, following the acquisition of 49% of it by Qatar Airlines.\u00a0 This is a minefield because it has Brexit Implications.\u00a0 Every airline with significant operations from the UK is now in the middle of doing the ownership and control two-step. \u00a0Airlines are applying for EU27 AOCs, or UK1 AOCs, as the case may be, so that they can continue their pan-European operations.\u00a0 UK airlines, like easyJet for example, now operates on its new Austrian AOC.\u00a0 Airlines like Ryanair and Wizz are proud owners of new UK AOCs.\u00a0 So that is ownership sorted.\u00a0 What about control \u2013 the woogie of what was once boogie woogie \u2013 which part of these manoeuvres addresses that?\u00a0 Mrs Bulc is fully aware of the implications so she trod a very fine line.\u00a0 She blamed the Italians.\r\n\r\n<strong>Tuesday <\/strong>looked at an altogether different sort of control.\u00a0 Caribbean Airlines <a href=\"https:\/\/www.atn.aero\/#\/article.html?id=68638\">launched<\/a> a \u2018signature cocktail\u2019. Rum-based; of course.\u00a0 Lufthansa took a different course.\u00a0 It went all \u2018ground control\u2019.\u00a0 Houston, we have a catering option for you: <a href=\"http:\/\/www.collectspace.com\/news\/news-070518a-lufthansa-space-food-astronaut.html\">dine on astronaut food<\/a>, straight from the zero-gravity can.\u00a0 Channel your inner Major Tom, by sitting in tin can, far above the world, and hum along to your favourite Bowie tunes.\r\n\r\n<strong>Wednesday <\/strong>saw controls of several different sorts.\u00a0 China <a href=\"http:\/\/carbon-pulse.com\/54919\/?utm_source=CP+Daily&amp;utm_campaign=53e397088e-CPdaily03072018&amp;utm_medium=email&amp;utm_term=0_a9d8834f72-53e397088e-110275789\">announced<\/a> that it is pulling out of CORSIA.\u00a0 You might think this a big deal, because it is, but the control freaks that have tried to tell the world that CORSIA is the Only Hope for saving the planet could not allow word to get out that it is falling apart.\u00a0 As if allowing petroleum-based fuels to count as emission friendly was not enough.\u00a0 They tried to bury that too, the industry boosters, by focusing on the procedural step of agreeing some standard practices that were always foreshadowed, but slowly, <a href=\"http:\/\/wwf.panda.org\/our_work\/governance\/policy\/wwf_europe_environment\/news\/?330171\/UN-aviation-agency-throws-lifeline-to-fossil-fuels-hampering-effectiveness-of-global-emissions-deal\">reality is dawning<\/a>.\r\n\r\nControl was also the topic for consideration at the European Court of Justice.\u00a0 On <strong>Thursday<\/strong> it pondered which of the marketing carrier or the operating carrier should a delayed passenger sue?\u00a0 Anybody involved in code-shares knows the answer to this: the marketing carrier has the contract with the passenger and is liable.\u00a0 It controls the operation of the flight even if it outsources parts of it to the operating carrier.\u00a0 It is hard to think of clearer thinking in aviation, and the <a href=\"https:\/\/curia.europa.eu\/jcms\/upload\/docs\/application\/pdf\/2018-07\/cp180100en.pdf\">ECJ agreed<\/a>.\u00a0 In a surprise move, it even added to the clarity.\u00a0 A note of respect to the lawyer that convinced the client this was a question worth litigating all the way to the ECJ though.\r\n\r\nAussies do airport regulation differently.\u00a0 The Australian Airport Association \u2013 the airports\u2019 trade body \u2013 announced a new policy earlier in the week.\u00a0 Profitable businesses should subsidise those that are struggling.\u00a0 Thus, profitable airlines should help unprofitable small airports (a tautology).\u00a0 Presumably, the reverse is also true and profitable large airports (also a tautology in Australia) should support struggling airlines.\u00a0 That was certainly the view of one of Australia\u2019s small, albeit profitable, regional airlines, which <a href=\"https:\/\/www.atn.aero\/#\/article.html?id=68686\">upped the ante<\/a> on
